The purpose of this policy is to ensure that where it is necessary to enforce standards that the Council achieves and maintains a consistent and balanced approach.
To achieve compliance with statutory requirements in private sector housing, the Council will, where possible, work informally with owners, landlords and managing agents. Where an informal approach is not effective in removing or reducing risks to the health and safety of occupants or other members of the public, the Council will consider the use of all relevant legislation to remove or reduce those risks.
Accommodation certificates - tolerable standard
Environmental Health - Private Housing can give advice regarding housing defects and the tolerable standard. In terms of the Housing (Scotland) Act 1987, the tolerable standard is a list of minimum requirements a house has to meet in order to be fit for habitation.
A house meets the tolerable standard if it:
- Is structurally stable;
- Is substantially free from rising or penetrating damp;
- Has satisfactory provision for natural and artificial lighting, for ventilation and for heating;
- Has an adequate piped supply of wholesome water available within the house;
- Has a sink with a satisfactory supply of both hot and cold water within the house;
- Has a water closet available for the exclusive use of the occupants of the house and suitably located within the house;
- Has a fixed bath or shower and a wash-hand basin, each provided with a satisfactory supply of both hot and cold water and suitably located within the house;
- Has an effective system for the drainage and disposal of foul and surface water;
- Has satisfactory facilities for the cooking of food within the house;
- Has satisfactory access to all external doors and outbuildings.
